1. About this policy
Endura Advisory Pty Ltd (ABN 61 700 592 972) respects your privacy and is committed to handling personal information responsibly.
This policy describes our general approach to personal information. It is intended to support compliance with the Privacy Act 1988 (Cth), the Australian Privacy Principles where they apply, tax file number requirements and applicable professional confidentiality obligations.
2. Information we may collect
Depending on how you interact with us, we may collect:
- identity and contact details, including your name, email address, telephone number and address;
- information you include in an enquiry or provide when seeking or receiving services;
- financial, taxation, superannuation, family, employment and business information relevant to an agreed engagement;
- government identifiers, including tax file numbers, where collection is authorised and reasonably necessary;
- professional correspondence, instructions, records and documents; and
- basic technical information processed by our website host for delivery, reliability and security, such as IP address, browser type and request time.
Please do not include tax file numbers, account details or other sensitive financial information in the website enquiry form.
3. How we collect information
We generally collect information directly from you through conversations, correspondence, engagement documents and information you provide for our services. We may also receive information from your authorised representatives or professional advisers, government agencies, regulators, service providers or publicly available sources where permitted by law.
The website enquiry form prepares a message in your own email application. The website itself does not submit the form to a database or store its contents. Your email provider processes the message when you choose to send it.
4. Why we collect, use and disclose information
We may handle personal information to:
- respond to enquiries and assess whether we can assist;
- establish, manage and deliver an agreed engagement;
- communicate with clients, trustees and authorised professional advisers;
- meet legal, regulatory, taxation, audit, insurance and professional obligations;
- manage conflicts, quality, security, administration and business records; and
- protect our systems and investigate suspected misuse or security incidents.
We will not use or disclose personal information for an unrelated purpose unless you consent or the use or disclosure is otherwise authorised or required by law.
5. Who we may disclose information to
Where reasonably necessary and permitted, we may disclose information to your authorised representatives, auditors, legal or other professional advisers, insurers, government agencies and regulators, and providers that support our email, document storage, accounting, practice-management, security, hosting and IT systems.
Where professional confidentiality rules require client permission before disclosure to a third party, we will seek that permission through an engagement letter or another appropriate written consent unless we have a legal duty to disclose.
6. Overseas processing
Some technology or professional service providers may store or process information outside Australia. Where the Australian Privacy Principles apply, we will take reasonable steps required by law before disclosing personal information overseas.
7. Security and retention
We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. No internet or storage system is completely secure.
We retain information for as long as reasonably required for the purpose for which it was collected and to meet legal, taxation, insurance and professional record-keeping obligations. When information is no longer required, we take reasonable steps to destroy or de-identify it where lawful and practicable.
8. Access and correction
You may ask to access personal information we hold about you or request that inaccurate, out-of-date, incomplete, irrelevant or misleading information be corrected. We may need to verify your identity. If we cannot fulfil a request, we will explain the applicable reason and available complaint options where required by law.
9. Privacy questions and complaints
